These Terms and Conditions govern your access to and use of adventurepursuitoutfitters.com, your purchase of merchandise, and your request, reservation, purchase or participation in trips, guided activities and other services offered by Adventure Pursuit Outfitters.
Adventure Pursuit Outfitters is referred to in these Terms as “Adventure Pursuit Outfitters,” “Company,” “we,” “us” or “our.”
By using our website, submitting a trip request, making a reservation, purchasing merchandise, paying a deposit or participating in an activity, you agree to these Terms and Conditions.

Adventure Pursuit Outfitters may offer:
· Guided fishing trips
· Guided hunting trips

· Wildlife, wilderness and recreational experiences

· Transportation associated with a trip
· Merchandise and outdoor products
· Other related services
The exact services, inclusions, exclusions, prices, dates, locations and participant requirements are identified in the applicable trip description, quote, booking confirmation or written agreement.
You must be at least 18 years old and legally capable of entering into a contract to make a reservation or purchase.
An adult making a reservation for other participants:
· Represents that the adult is authorized to provide the participants’ information.
· Accepts financial responsibility for the reservation.
· Agrees to communicate applicable trip requirements to all participants.
· Must ensure that each adult participant signs any required waiver or acknowledgment.
· Must ensure that a parent or legal guardian completes all required documents for a minor.
We attempt to keep website descriptions, schedules, prices, photographs and availability accurate. However:
· Availability can change before a reservation is confirmed.
· Photographs are illustrative and may not represent the exact conditions encountered.
· Wildlife, fish, weather and natural conditions are unpredictable.
· Typographical, technical and pricing errors may occur.
· Trip routes, locations, guides and equipment may change when reasonably necessary.
We may correct errors, update information or cancel an incorrectly priced reservation. If we cancel because of our error, we will refund amounts paid for the affected service.
Submitting a booking request does not necessarily create a confirmed reservation.
Unless the website expressly states that a reservation is immediately confirmed, a reservation becomes binding only after:
1. We review the request.
2. We confirm availability.
3. We send written confirmation.
4. The required deposit or payment is successfully received.
5. Required participant documents are completed by the stated deadline.
We may accept or decline a booking request based on guide availability, participant eligibility, equipment availability, legal requirements, safety considerations, weather, access conditions or other reasonable business considerations.
Do not make nonrefundable travel arrangements until you receive written confirmation from us.
Prices are stated in United States dollars unless otherwise indicated.
The advertised trip price includes only the items specifically identified as included. Unless expressly stated otherwise, prices do not include:
· Hunting or fishing licenses
· Tags, stamps, permits or access fees
· Travel to or from the meeting location
· Lodging
· Meals and beverages
· Gratuities
· Taxidermy or meat processing
· Shipping
· Personal equipment
· Optional rentals or upgrades
· Damage or cleaning charges
· Applicable sales, lodging or other taxes
You are responsible for reviewing the trip description and asking questions before submitting payment.
A deposit may be required to reserve a date, guide, boat, vehicle, lodging arrangement or other resource.
The deposit amount will be shown during checkout, in the quote or in the booking confirmation.
Unless otherwise stated in writing:
· The deposit is applied toward the total reservation price.
· A reservation is not held until the deposit is successfully received.
· The remaining balance is due no later than 3 days before the trip.
· Reservations made within 7 days of departurerequire full payment.
· Failure to pay the balance by the deadline may be treated as a customer cancellation.
· Processing fees and other charges may be nonrefundable where legally permitted and disclosed.
We may release an unpaid date or resource to another customer after providing reasonable notice.

Unless different terms are stated in the applicable trip confirmation, the following cancellation policy applies:
The customer may receive:
· A refund of amounts paid, less the deposit and any disclosed nonrecoverable expenses; or
· A trip credit, at our discretion and subject to availability.
Payments are nonrefundable, but we may offer a one-time trip credit equal to 75%of amounts paid, subject to availability.
All payments are nonrefundable and no credit is required.
Customers who fail to appear, arrive too late to participate safely, or leave a trip early are not entitled to a refund.
These cancellation periods should be replaced with the policy stated in your booking confirmation when the confirmation contains different terms.
A customer may request to reschedule by contacting us in writing.
Rescheduling is:
· Subject to availability
· Not guaranteed
· Limited to [ONE] rescheduling request
· Subject to any price difference
· Subject to nonrecoverable third-party costs
· Required to occur within [12] months of the original trip date
A rescheduling or administrative fee of 10% may apply when disclosed before the change is completed.
A requested reschedule made within the cancellation period may be treated as a cancellation.
We may delay, modify, relocate, shorten, reschedule or cancel a trip because of:
· Severe or unsafe weather
· Flooding, fire, drought or hazardous water conditions
· Unsafe road, trail, lake or property access
· Guide illness, injury or unavailability
· Boat, vehicle or equipment failure
· Government orders or closures
· Wildlife-management restrictions
· Insufficient participation
· Security or safety concerns
· Acts of God or other events outside our reasonable control
When we cancel a trip before it begins, our obligation will ordinarily be limited to one of the following:
· Rescheduling the trip
· Issuing a trip credit
· Refunding the amount paid directly to us for the canceled service
We are not responsible for independently purchased airfare, lodging, rental vehicles, lost wages or other incidental expenses. Customers are encouraged to purchase appropriate travel insurance.
Outdoor activities may proceed during rain, heat, cold, wind or other ordinary weather conditions.
The guide or Company determines whether conditions are sufficiently safe to begin or continue the activity.
A customer’s personal preference not to participate because of weather does not automatically entitle the customer to a refund when the Company determines that the activity can safely proceed.
Lightning, dangerous storms, flooding, wildfires, extreme temperatures and other unsafe conditions may result in delay, modification, rescheduling or cancellation.
Adventure Pursuit Outfitters does not guarantee:
· The presence or availability of fish or wildlife
· A successful catch or harvest
· A particular species, quantity, size or trophy quality
· Specific water, trail or weather conditions
· Photographic opportunities
· Wildlife behavior
· The customer’s personal performance or results
Guides provide professional assistance and local knowledge, but natural conditions and wildlife behavior are outside our control.
Failure to catch fish, encounter wildlife or harvest game does not entitle a customer to a refund.
Each participant is responsible for obtaining and carrying all legally required:
· Hunting licenses
· Fishing licenses
· Tags and endorsements
· Federal or state stamps
· Hunter-education documentation
· Identification
· Firearm or equipment documentation
· Permits required for the activity
Participants must follow all federal, state and local laws, season dates, bag limits, size limits, tagging rules, possession limits and lawful-method requirements.
As stated previously, licenses, tags and permits are not included in the trip price.
The customer must verify current requirements before the trip. We may refuse participation when a customer lacks required documentation, and no refund is required for that refusal.
Each participant must:
· Provide truthful and complete booking information.
· Arrive at the designated time and location.
· Follow guide instructions promptly.
· Use required safety equipment.
· Behave responsibly and respectfully.
· Remain within designated areas.
· Comply with applicable laws and property rules.
· Avoid conduct that endangers people, animals, property or the environment.
· Notify the guide immediately of an injury, unsafe condition or emergency.
· Be physically and mentally capable of participating safely.
Participants must not harass guides, landowners, other customers or members of the public.
Outdoor activities may involve walking, climbing, boating, standing, uneven terrain, heat, cold, water, remote locations, vehicle travel, exposure to insects and wildlife, and limited access to emergency medical services.
Before booking, participants should evaluate whether the activity is appropriate for their:
· Health
· Physical condition
· Mobility
· Experience
· Age
· Medical needs
Participants must disclose any limitation, allergy, medication requirement, mobility concern or medical condition reasonably relevant to safe participation.
We will consider reasonable accommodation requests when made sufficiently in advance, but not every trip, vessel, property or remote location can safely accommodate every condition.
Adventure Pursuit Outfitters does not provide medical advice. Participants should consult an appropriate healthcare professional when uncertain about their ability to participate.
The guide has final authority over operational and immediate safety decisions during a trip.
We may refuse or end a person’s participation when the person:
· Ignores safety instructions
· Acts recklessly
· Appears impaired
· Threatens or harasses another person
· Violates wildlife or property laws
· Mishandles equipment or weapons
· Fails to use required safety equipment
· Creates an unreasonable safety risk
· Provides materially false information
· Is physically unable to continue safely
A participant removed for misconduct or safety violations is not entitled to a refund.
Participants possessing firearms, bows, knives or other hunting equipment must:
· Possess them lawfully.
· Transport and store them in compliance with law.
· Follow all guide instructions.
· Keep firearms unloaded until authorized and safe to load.
· Maintain control of the equipment at all times.
· Use safe muzzle, trigger and shooting practices.
· Never discharge a weapon without authorization and a safe target.
· Refrain from using equipment while impaired.
We may inspect equipment for obvious safety concerns and may prohibit unsafe, unlawful or inappropriate equipment.
Adventure Pursuit Outfitters is not responsible for a participant’s failure to comply with firearm, hunting or transportation laws.
Illegal drugs are prohibited.
A participant may not possess or use a firearm, operate a vehicle or vessel, or participate in a hazardous activity while impaired by alcohol, cannabis, medication or another substance.
We may refuse participation to anyone who appears impaired. No refund is required when participation is refused for impairment or unsafe conduct.
A parent or legal guardian must approve a minor’s participation and sign all required documents.
Unless expressly approved by us:
· A responsible adult must accompany each minor.
· The accompanying adult is responsible for the minor’s supervision.
· Minors may participate only in age-appropriate activities.
· Applicable hunter-education and license requirements still apply.
· The guide may restrict a minor’s handling of firearms, boats, vehicles or equipment.
The minimum age for a particular activity may be stated in the trip description or booking confirmation.
Participants are responsible for bringing the clothing, footwear, licenses, medication and personal equipment identified in the trip instructions.
Equipment provided by Adventure Pursuit Outfitters must be:
· Used only as instructed.
· Returned at the end of the trip.
· Kept reasonably clean and undamaged.
· Reported immediately if lost, damaged or unsafe.
The customer may be charged for equipment lost or damaged through misuse, intentional conduct or failure to follow instructions.
Participants are responsible for their own personal property. We are not responsible for ordinary loss, theft, water damage or damage to phones, cameras, firearms, clothing, vehicles or other personal property, except to the extent caused by conduct for which liability cannot legally be excluded.
Some trips may involve third-party:
· Lodging
· Transportation
· Landowners
· Guides
· Boat operators
· Equipment suppliers
· Meat processors
· Taxidermists
· Restaurants
· Permit or access providers
Unless expressly stated otherwise, third parties are independent businesses and not employees of Adventure Pursuit Outfitters.
Their terms, cancellation rules and privacy practices may apply separately. We are not responsible for a third party’s independent acts, omissions, schedule changes or service quality, except where the law provides otherwise.
Hunting, fishing, boating, hiking, camping and wilderness activities involve inherent and other risks. These may include:
· Slips, trips and falls
· Drowning or immersion
· Boat or vehicle accidents
· Firearm or archery injuries
· Encounters with wildlife, insects or plants
· Heat illness, hypothermia or dehydration
· Severe weather
· Remote terrain
· Limited communications
· Delayed emergency response
· Equipment failure
· Acts of other participants
By booking, the customer acknowledges that outdoor activities involve risks that cannot be completely eliminated.
Each participant may be required to sign one or more of the following separate documents Participant Agreement, Assumption of Risk, Release of Liability and Emergency Medical Authorization before participating.
These website Terms are not intended to replace that separate participant document.
Refusal to complete a required waiver or safety document may result in cancellation of participation without a refund.
In an emergency, a participant authorizes Adventure Pursuit Outfitters and its guides to seek reasonable emergency assistance when the participant cannot do so.
The participant is responsible for medical, evacuation, ambulance, rescue and transportation expenses incurred on the participant’s behalf.
We do not guarantee that emergency services, cellular communication or immediate evacuation will be available in remote locations.
Adventure Pursuit Outfitters will not rely solely on these Terms as permission to use a participant’s identifiable image for advertising.
When we wish to use identifiable photographs, video, audio or testimonials for marketing, we may request a separate written or electronic media release.
Customers may notify the guide that they do not want to appear in casual group photographs. We will make reasonable efforts to honor that request.
Product orders are subject to availability and acceptance.
We may:
· Limit quantities
· Reject or cancel suspicious orders
· Correct pricing or description errors
· Substitute packaging when the product itself is unchanged
· Cancel an unavailable item and issue a refund
Product colors and appearance may vary because of screen settings, manufacturing differences and natural materials.
The customer is responsible for providing a complete and accurate shipping address.
Estimated shipping and delivery dates are not guarantees.
We are not responsible for delays caused by:
· Carriers
· Weather
· Customs
· Incorrect addresses
· Supply shortages
· Events outside our reasonable control
Risk of loss and title pass as provided by applicable law and the selected shipping arrangement.
Customers must promptly report missing, damaged or incorrect shipments to apo@adventurepursuitoutfitters.com
Unless a product listing states otherwise, unused merchandise may be returned within [30] days after delivery when it is:
· Unworn
· Unwashed
· Unused
· In original condition
· Accompanied by proof of purchase
The customer is responsible for return shipping unless the item was defective, damaged upon arrival or incorrectly shipped.
The following items are not returnable unless defective:
· Personalized or custom products
· Used outdoor equipment
· Opened sanitary or consumable products
· Gift cards
· Clearance or final-sale products
· Digital products
Original shipping charges are nonrefundable unless required by law or caused by our error.
Customers agree to provide accurate billing information and authorize the stated charges.
Before initiating a chargeback, customers should contact us at apo@adventurepursuitoutfitters.com and allow a reasonable opportunity to investigate and resolve the issue.
Submitting a knowingly false or fraudulent chargeback may result in collection activity, suspension of future bookings and recovery of lawful costs.
Nothing in this section limits a customer’s legitimate rights under payment-card rules or applicable law.
Promotions:
· Apply only during the stated period.
· Cannot be combined unless expressly allowed.
· Have no cash value.
· May be limited to particular trips or products.
· May exclude taxes, fees or third-party costs.
Gift cards and trip credits:
· Are subject to the terms disclosed when issued.
· Cannot be redeemed for cash except where required by law.
· May be transferred only with our approval.
· Must be presented before the applicable expiration date, if legally permitted.
Our collection, use and disclosure of personal information are governed by our Privacy Policy.

Customers should not submit Social Security numbers, complete payment-card details or unrelated medical information through ordinary email or website contact forms.
By submitting a reservation or purchase, you consent to receive transactional email or text communications concerning:
· Requests and confirmations
· Deposits and payments
· Trip instructions
· Schedule or weather changes
· Safety information
· Orders and shipping
· Customer-service matters
Marketing communications require any consent required by law and may be discontinued using the unsubscribe or opt-out instructions provided.
Electronic acceptance, confirmations and records may be used to document the transaction.
When account functionality is offered, you are responsible for:
· Maintaining the confidentiality of login credentials.
· Providing accurate information.
· Restricting unauthorized access.
· Notifying us of suspected unauthorized use.

To the fullest extent permitted by law, Adventure Pursuit Outfitters will not be liable for indirect, incidental, special, exemplary or consequential damages arising from website use, a delayed or canceled trip, loss of personal property or failure to achieve an expected outdoor result.
For claims arising from a product or service, our aggregate contractual liability will not exceed the amount paid directly to Adventure Pursuit Outfitters for the product or service giving rise to the claim.
This limitation does not apply to liability that cannot legally be limited, including liability arising from conduct for which limitation is prohibited by applicable law.
To the fullest extent permitted by law, you agree to reimburse and defend Adventure Pursuit Outfitters against third-party claims resulting from:
· Your unlawful conduct
· Your intentional misconduct
· Your violation of these Terms
· Your violation of hunting, fishing, firearm or property laws
· Damage you intentionally or recklessly cause
· False information you provide
· Your unauthorized use of another person’s information or payment method
This provision does not require you to indemnify Adventure Pursuit Outfitters for liability that cannot legally be shifted to you.
Adventure Pursuit Outfitters is not responsible for delay or failure caused by events beyond its reasonable control, including:
· Severe weather
· Natural disasters
· Wildfires
· Flooding
· Epidemics
· Government restrictions
· Road or property closures
· Utility or communication failures
· Labor disruptions
· Transportation interruptions
· Equipment or supply shortages
· Civil unrest
· War or terrorism
When reasonably possible, we will attempt to offer rescheduling, credit or another appropriate remedy under the applicable cancellation policy.

The parties agree to make a good-faith effort to resolve the dispute informally before filing suit.
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
Unless applicable law requires otherwise, legal proceedings must be filed in a court of competent jurisdiction located in Collin county, Texas.
Nothing in this section limits a consumer’s rights when applicable law prohibits a particular choice of law or venue.
We may revise these Terms to reflect changes in services, operations or law.
Revised Terms apply prospectively from the effective date posted on the website. Terms applicable to an existing confirmed reservation will ordinarily be those accepted when the reservation was completed, except for safety procedures, legal requirements or changes accepted by the customer.
If any provision is found invalid or unenforceable, the remaining provisions will continue in effect. The invalid provision will be enforced to the maximum extent legally permitted or replaced with a valid provision that most closely reflects its intended purpose.
Failure to enforce a provision does not waive the right to enforce it later.
These Terms, the Privacy Policy, the booking confirmation, any trip-specific written agreement and any separate participant waiver constitute the agreement relating to the applicable transaction.
When documents conflict, the following order generally controls:
1. A signed trip-specific agreement
2. The booking confirmation
3. A signed participant waiver for participation and risk matters
